Solrun Terms of Use

These Terms of Use ("Terms") are an agreement between you and ClankerMode LLC, a New Mexico limited liability company ("ClankerMode", "we", "us"), the company that makes the Solrun app ("Solrun" or "the app"). By downloading or using Solrun, you agree to these Terms. If you do not agree, please do not use the app.

Our Privacy Policy at https://solrun.app/privacy explains how Solrun handles personal data. Where the law requires your consent for something, we ask for it separately in the app.

1. How these Terms fit with Apple's license

You get Solrun from Apple's App Store. Your license to install and use the app is Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. ClankerMode LLC, not Apple, is the licensor and is responsible for the app.

These Terms add the rules that are specific to Solrun. If these Terms conflict with the Standard EULA, the Standard EULA controls, subject to any rights you have under the law that applies to you.

Apple is not a party to these Terms and is not responsible for the app, its content, support, or any claims about it. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it against you.

2. Who can use Solrun

You must be at least 13 years old to use Solrun. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you. Solrun is not directed to children under 13.

3. What Solrun does

Solrun helps you limit time in apps you choose. You pick apps, categories, or websites to block with Apple's Screen Time tools. You earn minutes of access by walking or running, measured on your iPhone with GPS and motion sensors. You spend those minutes when you open a blocked app.

Features, rates, and limits may change over time (see section 14). Some features are free. Others require a Solrun Pro subscription.

5. Screen Time blocking has limits

Solrun uses Apple's Screen Time tools (Family Controls, Managed Settings, and Device Activity). We do not control those tools, and they have limits.

Strict mode. If you turn on Strict mode, Solrun locks changes to your rate, banking rules, blocking, scheduled blocks, and Strict mode settings until you complete the step you chose (for example a run, spending banked minutes, a waiting period, or an emergency code). Notification and privacy settings stay open. While Strict mode is on, your iPhone does not let you delete any app, not only Solrun. To delete apps again, turn Strict mode off in Solrun first. That is the point of Strict mode, so only turn it on if you accept it. We have no servers and no account for you, so we cannot turn Strict mode off for you from our side.

Solrun is free to download. Solrun Pro is an optional auto-renewing subscription sold by Apple through In-App Purchase.

Solrun, including its design, code, text, graphics, and logos, belongs to ClankerMode LLC and its licensors and is protected by intellectual property laws. "Solrun" and the Solrun logo are our trademarks. These Terms do not give you any rights to them beyond using the app as allowed here.

Your run history and settings stay on your device. When you share a share card, you decide where it goes, and the terms of the app or service you share it to apply.

If you send us feedback or ideas, we may use them without owing you anything.

9. Third-party services

Solrun relies on services from other companies, including Apple (App Store, In-App Purchase, iOS, Screen Time, Maps), Superwall (subscription offers and purchases), and PostHog (app usage statistics, which you can turn off in settings). Their own terms and privacy policies apply to their services. Our Privacy Policy explains what data each of them receives.

10. Disclaimers

The app is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, express or implied, including that the app will be accurate, uninterrupted, error free, or fit for a particular purpose, or that blocking will always work.

Some countries and states do not allow some of these disclaimers, so some of them may not apply to you. They never limit the rights described at the end of section 11.

11. Limitation of liability

To the fullest extent the law allows:

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you, such as liability for fraud or, where the law requires it, for death or personal injury caused by negligence. If you are a consumer in the European Union, the United Kingdom, or another country with mandatory consumer rights, sections 4, 10, and 11 do not affect those rights.

12. Ending your use

You can stop using Solrun at any time by deleting the app (turn off Strict mode first if it is on). Remember to cancel any subscription through Apple.

We may stop offering the app or any feature, or end your right to use it if you seriously break these Terms.

If we stop offering Solrun Pro, we will stop new purchases and renewals, and Pro will keep working for the rest of any period you have already paid for. If that is not possible, you will get the refund or other remedy the law requires.

Sections 4, 5, 8, 10, 11, 13, and 14 continue to apply after your use ends.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict of law rules. Apple's Standard EULA has its own governing law clause, which applies only to the license under that EULA. Any dispute that is not resolved informally will be handled in the state or federal courts located in Bernalillo County, New Mexico, and you and we agree to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead.

Before filing a claim, please email us at support@clankermode.com so we can try to fix the problem.

If you live in the European Union, the United Kingdom, or another country that gives consumers mandatory rights, you keep those rights, including the protection of your local consumer laws and the right to bring a claim in your local courts. Nothing in these Terms takes those rights away.
